How Under 21 DUI Charges Are Different
Assuming a first offense, the jail time (2 days to 1 year) fines ($500 to $1,000) and license suspension (up to 1 year) are the same. What’s unique about an under 21 charge is that the driver does NOT have to be over the .08% limit for drivers of legal drinking age. Someone who is under 21 only needs to be “affected to a noticeable and perceptible degree” to be arrested for DUI.
Will this Affect MY Auto Insurance?
There are some rare cases where auto insurance companies will cancel (or refuse to renew) your auto insurance policy after an underage DUI charge. What most insurance companies will do is raise your rates and force you to a “higher risk” policy. This can cost as much as $100 to $200 a month more than normal insurance. You may need to stay with this type of policy for as much as 3 to 5 years.
